STANDARD TERMS AND CONDITIONS
Note: Variations to these Terms and Conditions may only be made by prior written agreement with the Owner.
This Rental Agreement and Contract is a legally binding agreement made as of the Reservation Date between the Guest or Tenant and the Rental Agent and their agents, owners, successors, employees, managers and contractors. By entering into this agreement, the Guest agrees to rent the Property for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.
By paying a deposit for the apartment, it is accepted that these conditions have been read, understood and agreed to by the prospective Guest or Tenant.
To maintain a high standard for our guests, the following conditions must be complied with.
OCCUPANCY AND REGISTERED GUESTS
The number of Guests must not exceed the number stated on the Confirmation Notice or subsequently agreed in writing.
Only registered guests listed on the booking confirmation may stay overnight at the Property. Maximum occupancy limits must not be exceeded at any time. Visitors must not remain overnight unless prior written approval has been obtained.
If occupancy exceeds the approved number of guests, including children, this may result in immediate termination of the rental agreement, eviction without refund and forfeiture of bond.
USE OF PROPERTY
This Property is for domestic residential use only and must not be used for commercial purposes. The rental rate does not allow for additional wear associated with events, functions, gatherings or organised activities.
The Property is subject to a strict no-party and no-event policy. Parties, celebrations, gatherings, Schoolies bookings and unauthorised events are strictly prohibited. The Property must not be used for commercial functions or organised gatherings.
Any breach may result in immediate termination of the booking, eviction without refund, forfeiture of the Security Bond and liability for damages, fines, security call-out fees and associated costs.
Guests must refrain from loud noise and must not disturb, annoy, endanger or inconvenience neighbours. Guests must not engage in offensive, abusive or unlawful behaviour, nor commit waste or nuisance on or about the Property.
Complaints from neighbours, Owners Corporation or Police may result in termination of rental and loss of bond.
PERSONAL PROPERTY
All personal property, furnishings and other items brought onto the premises by the Guest or their visitors remain at the sole risk of the Guest. The Owner and Rental Agent accept no liability for theft, damage, destruction or loss.
LIABILITY AND INDEMNITY
The Guest agrees to indemnify and hold harmless the Rental Agent, Owner and associated parties from any claims, damages, liabilities, legal fees or losses arising from injury, death or property damage occurring on or about the premises.
The Guest waives any claims against the Rental Agent and Owner for injuries or loss sustained while using the Property or associated facilities, acknowledging such use is at their own risk.
To the maximum extent permitted by law, the Owner and Manager are not liable for any loss, damage, injury, delay or inconvenience arising from circumstances beyond their reasonable control, including but not limited to utility outages, maintenance works, construction, third-party actions, pest presence, weather events or force majeure circumstances.
Nothing in these Terms excludes or modifies any rights that cannot lawfully be excluded under applicable legislation.
SECURITY BOND
A Security Bond is required for each booking and the amount will be specified at the time of booking.
For direct bookings, the Security Bond must be paid prior to arrival and is held as security against damage, loss, breach of these Terms and Conditions, additional cleaning, excess occupancy, unpaid charges or fines.
The Security Bond paid for the property will be refunded within seven (7) working days after check-out, provided that the Property has been left in good condition, no damage or excessive cleaning is identified, no breach of these Terms has occurred and no outstanding charges remain payable.
The Owner or Manager reserves the right to deduct reasonable costs for repair or replacement of damaged items, professional cleaning beyond standard turnover, removal of excess rubbish, smoke odour remediation, security or trades call-out fees, building management fines and any costs arising from breach of these Terms.
If damage exceeds the bond amount, the Guest remains legally liable for the outstanding balance.
DAMAGE AND INCIDENT REPORTING
Guests must promptly notify the Host or Manager of any damage, breakages, safety concerns, maintenance issues or incidents affecting the Property. Failure to notify may result in additional liability.
SMOKING POLICY
Smoking is strictly prohibited inside the Property.
Evidence of smoking, including odour or residue, will result in professional cleaning charges, deduction from the Security Bond and additional remediation costs where required.
PET POLICY
Pets are not permitted unless prior written approval is obtained. Unauthorised pets may result in eviction without refund and additional charges.
PEST AND WILDLIFE DISCLAIMER
Due to Australia’s climate and natural environment, insects and wildlife may be present. The Property is regularly treated; however, the presence of insects or wildlife does not constitute grounds for cancellation or refund. No liability is accepted for bites, stings or wildlife encounters.
CONSTRUCTION AND FACILITY DISCLAIMER
Guests acknowledge that construction or maintenance works may occur nearby and that common facilities may be temporarily closed. Such matters are beyond the Host’s control and no refunds or compensation will be provided for inconvenience arising from such circumstances.
CLEANING REQUIREMENTS (LONG STAYS)
For stays exceeding six (6) weeks, a professional cleaning service is required every three (3) weeks at a cost of AUD $100–$190 per service (depending on property size), payable directly to the Agent and inclusive of linen change.
If Guests provide their own linen, the service becomes optional.
CHECK-IN AND CHECK-OUT
Check-in time is 3:00 pm unless otherwise agreed in writing.
Check-out time is 10:00 am.
The Property must be left in a similar condition to arrival, including removal and disposal of perishable garbage. Guests must remove rubbish, wash dishes, remove excessive sand and dirt, secure doors and windows, and turn off lights and air conditioning prior to departure.
Late departure or early arrival may incur additional charges unless previously agreed in writing.
CANCELLATION POLICY
All payments made are non-refundable.
GENERAL CONDITIONS
Candles are not permitted in the apartment.
No furniture, linen (other than beach towels) or effects may be removed from the apartment without prior authorisation.
Linen and towels are supplied.
Loss of security key will incur a $300 replacement fee.
INFORMATION BOOKLET
A hard copy of the code of conduct and Property Information Booklet is provided within the Property. Guests acknowledge that it is their responsibility to review and comply with all instructions and safety guidelines contained therein.
By paying the deposit, the Guest confirms that these Terms and Conditions have been read, understood and agreed to.
